PETCO GREAT ONES CONTEST (“Contest”)
OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

THIS CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. VOID WHERE PROHIBITED.

 

  1. ELIGIBILITY: The Contest is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry. Employees, officers and directors (and their immediate families [spouse, children, parents, siblings] and those living in their same households [whether or not related]) of Petco Animal Supplies, Inc. (“Sponsor”), Tic Toc, Inc. (“Administrator”) and any of their respective parent, subsidiary, and affiliated companies, advertising, promotion, or production agencies and web masters/suppliers (collectively “Promotion Parties”) are not eligible to participate. By participating, entrants agree to these Official Rules, which are final and binding in all respects.

  2. PROMOTION PERIOD: Contest begins on March 1, 2013 at 12:00:00 a.m. Pacific  Standard Time (“PST”) and ends on August 25, 2013 at 11:59:59 p.m. Pacific Daylight Time (“PDT”) (“Promotion Period”). The Sponsor's clock is the official clock for this Contest.

  3. HOW TO ENTER: Enter the Contest by visiting www.beagreatone.com or the Great Ones Contest application on the Petco Facebook page at www.facebook.com/petco (the “Websites”); complete the online entry form by providing your name, email address, phone number, and mailing address; select a non-profit organization from the list of pre-approved organizations (the “Petco Foundation Animal Welfare Charitable Partners”); and upload (1) an original video (“Video”) explaining why you are a “great one to your pet,” or (2) an essay (“Essay”), five hundred (500) words or less, with an optional photo, explaining why you “are a great one” to your pet. Completion of this process constitutes an entry into the Contest (“Entry”). If submitting a Video, your Video must be no longer than six (6) minutes in duration, in English, and no larger than 2 GB in size. Please note: This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to Sponsor and not to Facebook. The information you provide will only be used as provided in Sponsor's privacy policy, located at https://www.petco.com/petco_Page_PC_helplist_ContentID_3040_TopicID_8.aspx . Any questions, comments or complaints regarding this Contest shall be directed to Sponsor and not to Facebook.

    One (1) Entry per person/email address/Facebook account per month. For the purposes of this Contest, a month is defined as follows:

    Any form of submission other than that described herein is void. Any attempt by any participant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's Entries and that participant may be disqualified. In the event of a conflict between the Contest Official Rules and Facebook Terms of Use, the Contest Official Rules shall govern. Entries will not be acknowledged or returned. Should multiple users of the same e-mail account enter the Contest and a dispute thereafter arises regarding the identity of the entrant, the authorized account holder of said e-mail account at the time of Entry will be considered the entrant. “Authorized account holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain name associated with the submitted e-mail address. Please see the privacy policy located at http://www.petco.com/petco_Page_PC_helplist_ContentID_3040_TopicID_8.aspx for details of Sponsor's policy regarding the use of personal information collected in connection with this Contest. Those who do not follow all of the instructions, provide the required information in their submission, or abide by these Official Rules or other instructions of Sponsor may be disqualified.

    BY SUBMITTING AN ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED ON THE WEBSITES, AT SPONSOR'S DISCRETION. Submission of an Entry grants Sponsor and its agents the right to publish, use, adapt, edit, publicly perform and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the entrant.

  4. SUBMISSION GUIDELINES: By submitting an Entry, you agree that your submission is gratuitous and made without restriction, and will not place Sponsor under any obligation, that Sponsor is free to disclose or otherwise disclose the ideas contained in the Entry on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation to you. You acknowledge that, by acceptance of your submission, Sponsor does not waive any rights to use similar or related ideas previously known to Sponsor, or developed by its employees, or obtained from sources other than you. Sponsor reserves the right to, and may or may not, monitor/screen Entries. By entering, you acknowledge that Sponsor has no obligation to use or post any Entry you submit.

    By submitting a Entry you warrant and represent that it: (a) is your original work, (b) has not been previously published, (c) has not won previous awards, (d) does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity; (e) that you have obtained permission from a person who's name, likeness or image is used in the photo or Video and (f) and that publication of the Entry via various media including Web posting, will not infringe on the rights of any third party rights. Any such entrant will indemnify and hold harmless, Sponsor and Releasees (defined below) from any claims to the contrary.  Any entrant whose work includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor's use of such Entry, in a form satisfactory to administrator, upon request, prior to awarding of prize. 

    As determined by the Sponsor, in its sole discretion, Entries must meet the following guidelines:
    1. Must comply with these Official Rules and any Terms of Service on the Websites;
    2. Cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, or contain nudity;
    3. Cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
    4. Cannot be obscene or offensive, endorse any form of hate or hate group;
    5. Cannot promote terrorist acts such as providing instructions on how to assemble bombs, grenades and other such weapons or provide instructional information about illegal activities;
    6. Cannot defame, misrepresent or contain disparaging or slanderous remarks about Sponsor, its customers or its products, or other people, products or companies;
    7. Cannot contain trademarks, logos or trade dress owned by others (except Sponsor's trademarks, logos or trade dress), or advertise or promote any brand or product of any kind (except Sponsor's products), without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
    8. Cannot contain copyrighted materials owned by others (including photographs, videos, sculptures, paintings and other works of art or images published on or in Web Sites, television, movies or other media or musical "samples" other than the musical tracks provided, except such materials owned by Sponsor) without permission;
    9. Cannot contain background artwork, unless it is an original work of the entrant;
    10. Cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, other than the entrant, without permission;
    11. Cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate
    12. Cannot depict, and cannot itself, be in violation of any law.


    Because Sponsor promotes the compassionate care of all pets, Videos, photos, photo captions, and Essays showing or describing unsafe situations or not exemplifying responsible pet ownership, in Sponsor's sole discretion, will not be considered.

    ENTRIES POSTED TO THE WEBSITES (IF ANY) WERE NOT EDITED BY SPONSOR AND ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants. Sponsor reserves the right to waive the Contest entry requirements set forth herein in its reasonable discretion. By entering, you acknowledge that Sponsor has no obligation to use or post any Entry you submit.

  5. CONTEST JUDGING CRITERIA: All Entries submitted during each Entry Period Month will be judged each Entry Period Month by a qualified judge or panel of judges, appointed by the Sponsor, based upon the following criteria (“Judging Criteria”): (1) Entry emphasizes the attributes of a “great one” ([30]%); (2) originality ([15]%); (3) technical excellence ([10]%); (4) composition ([10]%); (5) overall impact ([25]%); and (6) artistic merit ([10]%). Ten (10) Entries will be selected as finalists (“Finalists”) each Entry Period Month and notified on the Potential Finalist Notification Date listed above (the “First Judging Round”).

    Sixty (60) Finalists will advance to the final judging round (“Final Judging Round”), to be held on or about September 2. During the Final Judging Round, Each Finalist Entry will be judged by a qualified judge or panel of judges, appointed by Sponsor, based upon the Judging Criteria and receive a new score. Scores from the First Judging Round will not carry over into the Final Judging Round.    

    The one (1) Entry with the highest total score after the Final Judging Round will be deemed the Grand Prize Winner, subject to verification. The one (1) Entry with the second highest total score after the Final Judging Round will be deemed the First Prize Winner, subject to verification. The three (3) Entries with the third, fourth, and fifth highest total scores after the Final Judging Round will be deemed the Runner-Up Prize Winners, subject to verification. The verified Grand Prize Winner, First Prize Winner, and Runner-Up Prize Winners are collectively referred to herein as “winners.” In the event of a tie, tie breaker will be based upon the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed, to break the tie. The judge(s)' decisions are final in all matters relating to this Contest.

  6. PRIZES (3):
    1. Grand Prize (1): Fifty thousand dollars ($50,000) awarded in the form of a check payable to the winner. Sponsor will separately award fifty thousand dollars ($50,000) directly to winner's selected non-profit organization.
    2. First Prize (1):  Twenty-five thousand dollars ($25,000) awarded in the form of a check payable to the winner. Sponsor will separately award twenty-five thousand dollars ($25,000) directly to winner's selected non-profit organization.
    3. Runner-up Prizes (3):  Five thousand dollars ($5,000) awarded in the form of a check payable to the winner. Sponsor will separately award five thousand dollars ($5,000) directly to winner's selected non-profit organization.

    Total approximate retail value of all prizes awarded to winners: $90,000.00. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor's parent or legal guardian who must sign and return all required documents. Winners are solely responsible for all taxes on prizes (including but not limited to federal, state and local income taxes), and for any other fees or costs associated with the prize they receive, regardless of whether it, in whole or in part, is used. Winners will be required to provide his/her Social Security Number for tax reporting purposes. Winners will be issued an IRS 1099 tax for the value of the prize. Limit one (1) prize per person/household. Unclaimed prizes will not be awarded.

  7. WINNER NOTIFICATION/REQUIREMENTS: The potential Finalists will be notified by email on or about the Potential Finalist Notification Date listed above. The potential winners will be notified by email on or about September 9. Potential winners are subject to verification, including verification of age. If Sponsor cannot locate a winner within ten (10) days of date of attempted notification, or if prize notification or any prize is returned as undeliverable, the potential winner may be disqualified and any prize may be forfeited, in Sponsor's sole discretion. Sponsor is not responsible for any change of email address of entrants. Prizes cannot be assigned, transferred, redeemed for cash or substituted, except that Sponsor reserves the right to substitute the prize with a prize of equal or greater value if promoted prize becomes unavailable.

  8. GENERAL CONDITIONS: By entering this Contest, entrants agree and covenant on behalf of themselves and their family, heirs, personal representatives executors, assigns and insurers, (a) to release, acquit, hold harmless, waive and forever discharge Sponsor, Tic Toc, Inc., Facebook, Inc., and their respective parent companies, subsidiaries and affiliates, and their respective officers, directors, members, managers, employees, contractors and agents (collectively, “Releasees”) from any and all claims, demands, damages, debts, costs, fees, obligations, loss, expenses, compensation, actions or causes of action whatsoever, of every nature, character and description, whether known, unknown, discovered, undiscovered, suspected or unsuspected, including death, or property damage (collectively, “Claims”), including but not limited to Claims arising on account of, or in any way growing out of, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Contest or any Contest related activities, or any travel related thereto, (b) except where legally prohibited, winner grants (and agree to confirm that grant in writing) permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval. Potential winner will be required to complete, sign, notarize and return an Affidavit of Eligibility, a Liability Release, a Form W9, and where lawful a Publicity Release, within ten (10) days of receipt of notification in order for potential winner to be verified as a winner and claim his/her prize. Potential Contest Winner will be required to sign documents assigning all right and title, including copyright, in and to the Entry, to Sponsor. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor's parent or legal guardian who must sign and return all required documents. If documents are not returned in a timely manner, or if the prize notification or prize is returned as non-deliverable, or if a winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize may be forfeited.

  9. LIMITATIONS OF LIABILITY: Sponsor is not responsible for incorrect or inaccurate Entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the Entries. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature. Sponsor is not responsible for any computer or e-mail failures that may result in lost or garbled Entries or which affect the administration of the Contest. Sponsor assumes no liability for incorrect, lost, late, stolen, illegible, incomplete, misdirected, damaged non-delivered requests or Entries, computer system or transmission line errors, software or hardware malfunctions, or other errors, failures, or delays in transmission that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from downloading or entering any part of this Contest. If, for any reason, Contest, in the sole opinion of Sponsor, is not capable of running as planned in the sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend Contest, and determine winner from eligible non-suspect Entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. Automated Entries are prohibited, and any use of automated devices will cause disqualification. Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Entries) who tampers with the Entry process.

  10. BINDING ARBITRATION: BINDING ARBITRATION:  Any controversy or claim arising out of or relating to the Contest shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply California law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty (60) days after the demand for arbitration is made, unless further extended by mutual agreement of the parties.  THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED.  DO NOT ENTER THIS CONTEST IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.

    BY PARTICIPATING IN THE CONTEST, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY); (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT.

  11. GOVERNING LAW AND JURISDICTION: These Official Rules and the Contest are governed by US law and are subject to all applicable federal, state and local laws and regulations. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A. without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 10 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the federal, state and local courts located in San Diego County, California.

  12. WINNER LIST: For the name of the prize winner, send a self-addressed, first-class stamped envelope to: Petco Great Ones Contest, 9125 Rehco Rd., San Diego, CA 9212. Requests must be received by October 30, 2013.
